Lighting the menorah - whose mitzva?

The possuk in this week’s sedrah says: וַיְדַבֵּר ה' אֶל מֹשֶׁה לֵּאמֹר. דַּבֵּר אֶל אַהֲרֹן וְאָמַרְתָּ אֵלָיו בְּהַעֲלֹתְךָ אֶת הַנֵּרֹת אֶל מוּל פְּנֵי הַמְּנוֹרָה יָאִירוּ שִׁבְעַת הַנֵּרוֹת. Hashem said to Moshe to say; Speak to Aharon and tell him, “When you light the lights [of the menora] you should make them shine towards the centre of the menorah.”  The possuk seems to say that a cohen, in this case Aharon, should light the menora. The Rambam, however ( הלכות ביאת מקדש, פרק תשיעי, הלכה ז '),  says that a non-cohen is allowed to light the menora: וכן הדלקת הנרות כשירה בזרים לפיכך אם הטיב הכהן את הנרות והוציאן לחוץ מותר לזר להדליקן “Lighting the lamps is kosher with a non-cohen therefore if the cohen prepared the lamps [in the heichal] and brought the menora into the azara (where a non-cohen is allowed to be) it is mutar for a non-cohen to light them.” The Ra’avad asks on the Rambam: אמר אברהם הפליג כשאמר מותר לזר להדליקן אלא שאם הדליקן כשירות “The Rambam is exa...

Nezirus Shimshon

In this week’s sedrah the Torah describes the halachos of nezirus . The Torah changes the title of the nazir as it relates the different halachos : The Torah begins by describing the issur on wine. Here the Torah describes the nazir as a nazir la’hashem . ...אִישׁ אוֹ אִשָּׁה כִּי יַפְלִא לִנְדֹּר נֶדֶר נָזִיר לְהַזִּיר לַה'. מִיַּיִן וְשֵׁכָר יַזִּיר חֹמֶץ יַיִן וְחֹמֶץ שֵׁכָר לֹא יִשְׁתֶּה ... “A man or a woman who expresses a neder (promise) to become a nazir to Hashem. From wine and mead he should refrain, he should not drink wine vinegar or mead vinegar…” Then the Torah adds the issurim of not eating any part of the grape and not having a haircut. Here the Torah does not call him a nazir la’hashem , it merely refers to him as a nazir : כֹּל יְמֵי נִזְרוֹ מִכֹּל אֲשֶׁר יֵעָשֶׂה מִגֶּפֶן הַיַּיִן מֵחַרְצַנִּים וְעַד זָג לֹא יֹאכֵל. כָּל יְמֵי נֶדֶר נִזְרוֹ תַּעַר לֹא יַעֲבֹר עַל רֹאשׁוֹ However when the Torah adds the issur of not becoming tame le’mes , the Torah calls him...

Carrying the aron ha'kodesh

At the end of this week’s sedrah the Torah desribes the mitzva for the leviim to carry the mishkan. The Torah says that the family of Kehas had to carry the kelim from the kodesh hakedoshim including the aron hakodesh : זֹאת עֲבֹדַת בְּנֵי קְהָת בְּאֹהֶל מוֹעֵד קֹדֶשׁ הַקֳּדָשִׁים. וּבָא אַהֲרֹן וּבָנָיו בִּנְסֹעַ הַמַּחֲנֶה וְהוֹרִדוּ אֵת פָּרֹכֶת הַמָּסָךְ וְכִסּוּ בָהּ אֵת אֲרֹן הָעֵדֻת... וְאַחֲרֵי כֵן יָבֹאוּ בְנֵי קְהָת לָשֵׂאת “This is the work of Kehas in the ohel moed – the kodesh ha’kedoshim . Aharon and his sons should come when the camp travels and they should take down the paroches and cover the aron hakodesh with it. Eruchin - how they work

At the end of Bechukosai the torah specifies the halachos of eruchin. If a person says  - ערך פלוני עלי - “I will give the value of someone ,” the Torah fixes the amount that he has to pay to the beis hamikdash. This varies according to the age and gender of the person whose value he is giving. Heseg yad If the donor cannot afford to give the full erech then the cohen estimates how much he can afford: וְאִם-מָךְ הוּא מֵעֶרְכֶּךָ וְהֶעֱמִידוֹ לִפְנֵי הַכֹּהֵן וְהֶעֱרִיךְ אֹתוֹ הַכֹּהֵן  עַל-פִּי אֲשֶׁר תַּשִּׂיג יַד הַנֹּדֵר יַעֲרִיכֶנּוּ הַכֹּהֵן “If he is too poor to give the full erech then he shall stand the person whose value he is donating before the cohen and the cohen shall value him according to the amount that the donor can afford.” The Rambam in Hilchos Eruchin (3:6) talks about a case where a poor person obligated himself to give the same as a wealthy person: עשיר שאמר ערכי עלי או ערך פלוני ושמע העני ואמר מה שאמר זה עלי הרי העני חייב בערך עשיר שהוא ערך שלם ...

Honouring the cohen - even if he does not want the honour

The possuk says in this week’s sedrah: וְקִדַּשְׁתּוֹ כִּי-אֶת-לֶחֶם אֱלֹקיךָ הוּא מַקְרִיב קָדֹשׁ יִהְיֶה-לָּךְ כִּי קָדוֹשׁ אֲנִי ה' מְקַדִּשְׁכֶם. The Rambam derives two halachos from this passuk: 1. Honouring the cohen: In Sefer haMitzvos (mitzva 32) the Rambam explains that וְקִדַּשְׁתּוֹ means that you should honour the cohen: מצוה ל"ב היא שצונו לכבד זרע אהרן לפארם ולנשאם ושׁנשׂים מדרגתם מדרגה קודמת וראשונה ואפילו ימאנו לא נשמע להם וזה כולו הגדלה לקל יתעלה אחר שהוא לקחם ובחרם לעבודתו ולהקריב קרבנותיו והוא אמרו יתעלה יתברך שמו וקדשתו כי את לחם אלקיך היא מקריב “Mitzva ל"ב is that Hashem commanded us to honour the decendants of Aharon to glorify them and to respect them and to always ensure that they come first.  Even if they refuse we should not listen to them. Entering the kodesh ha'kedashim

The gemara in Kerisus 6a says: ת"ר פיטום הקטרת הצרי והציפורן והחלבנה והלבונה משקל שבעים של שבעים מנה מור וקציעה שיבולת נרד וכרכום משקל ששה עשר של ששה עשר מנה הקושט שנים עשר קילופה שלשה וקנמון תשעה בורית כרשינה תשעה קבין יין קפריסין סאין תלתא קבין תלתא אם אין לו יין קפריסין מביא חמר חיוריין עתיק מלח סדומית רובע מעלה עשן כל שהוא ר' נתן אומר אף כיפת הירדן כל שהוא ואם נתן בה דבש פסלה חיסר אחת מכל סמניה חייב מיתה Rashi says that the chiyuv misoh that the beraisoh is referring to is if a cohen gadol used this ketores on Yom Kipur: ד״ה חייב מיתה - כי עייל ביוה"כ דכתיב (שם טז) ואל יבא בכל עת אל הקודש וגו' ולא ימות וגו' בזאת יבא אהרן וגו' וכי מעייל קטרת שלא כהלכתה ביאה ריקנית היא וחייב מיתה “The beraisoh is referring to Yom Kippur. Different types of skin tzara’as The possuk in this week’s sedrah describes different types of tzara’as that can occur in skin: אָדָם כִּי יִהְיֶה בְעוֹר בְּשָׂרוֹ שְׂאֵת אוֹ סַפַּחַת אוֹ בַהֶרֶת וְהָיָה בְעוֹר בְּשָׂרוֹ לְנֶגַע צָרָעַת וְהוּבָא אֶל אַהֲרֹן הַכֹּהֵן אוֹ אֶל אַחַד מִבָּנָיו הַכֹּהֲנִים “When a man shall have in the skin of his flesh a se’es, or a sapachas , or a baheres , and it becomes in the skin of his flesh a plague of leprosy, then he shall be brought to Aaron the cohen, or to one of his sons the cohanim.” The mishna in the beginning of Negaim (( מסכת נגעים פרק א' משנה א ' explains that a סַפַּחַת is not a type of tzara’as – rather it is a tolda (sub-type) of one of the two main types ( avos ) of tzara’as: מראות נגעים, שנים שהן ארבעה:  בהרת עזה כשלג, שניה לה כסיד ההיכל; והשאת כקרום ביצה, שניה לה כצמר לבן, דברי רבי מאיר.  וחכמים אומרין, שאת כצמר לבן, שניה לה כקרום ביצה . “There are 2 main types of tzaraas, each of which has a subtype. Kosher eggs

The gemara in Bechoros 6b asks why we are allowed to drink milk, why is it not ossur because of ever min hachai ? The gemara brings various pessukim to prove that it is kosher: וחלב דבהמה טהורה מנלן דשרי ... מדכתיב (שמואל א יז) ואת עשרת חריצי החלב ... ואיבעית אימא מהכא (שמות ג) ארץ זבת חלב ודבש ואי לא דשרי משתבח לן קרא במידי דלא חזי ואיבעית אימא מהכא (ישעיהו נ"ה) לכו שברו ואכלו ולכו שברו בלא כסף ובלא מחיר יין וחלב    “How do we know that it is mutar to drink milk from a kosher animal? Work on Yom Tov - davar hashaveh lekol nephesh

The mishna says in Beitza (12a): בית שמאי אומרים: אין מוציאין לא את הקטן ולא את הלולב ולא את ספר תורה לרשות הרבים. ובית הלל מתירין "Beis Shammai say that you cannot carry a child, a lulav or a sefer torah into the street on Yom Tov and Beis Hillel say that this is mutar."   The gemara explains that Beis Shammai say that you can only do melacha on Yom Tov if it is for the purpose of preparing food, however Beis Hillel say that since you can carry in order to eat on Yom Tov, you can also carry for non-food related purposes.   This is called mitoch : מתוך שהותרה הוצאה לצורך הותרה נמי שלא לצורך “Because you can carry for eating you can also carry for non food related purposes.”   There is a machlokess Rashi and Tosafos if this halacha applies even in a case where the melacha is done for no reason at all. For example, are you allowed to carry stones in the street for no reason? Rashi explains that once you say mitoch – you can do the melacha for no reason at all. Ho...

Hallel on the Seder Night

The Rambam in Hilchos Chanuka (3:6) says: ולא הלל חנוכה בלבד, הוא שמדברי סופרים, אלא קריאת ההלל לעולם מדברי סופרים, בכל הימים שגומרין בהן את ההלל Not only is hallel on Chanuka miderabonon but reading hallel is always miderabonon on all days when we complete hallel. The ra’avad asks:  אמר אברהם ויש בהם עשה מדברי קבלה השיר יהיה לכם How can the Rambam say that hallel is always derabonon ? Sometimes the chiyuv to say hallel is more than a miderabanan , it is from the neviim, as it says in Yeshaya (30:29): הַשִּׁיר יִהְיֶה לָכֶם, כְּלֵיל הִתְקַדֶּשׁ-חָג The possuk is talking about the downfall of Sancheriv, and says that when Sancheriv is destroyed, the benei Yisroel will say shiroh as on the first night of Pesach. You see from here that the chiyuv to say hallel on the seder night is midivrei neviim , not simply miderabonon ?
